Court fees in cases of claims resulting from banking activities
The act on court fees in civil cases has recently been amended. Important changes have been made as regards relative fees charged in claim cases resulting from banking activities.
The Act of 25 September 2015 amending the Banking Act and certain other acts (Dz. U. [Journal of Laws] 2015 item 1854) adds a new article to the Act on court fees in civil cases – Article 13 Paragraph 1a, pursuant to which in claim cases resulting from banking activities the relative fee (charged for filing a suit or an appeal, among other things) amounts to 5% of the value of the object of litigation, being, however, no lower than PLN 30.00 and no higher than PLN 1000.00. The article entered into force on 27 November 2015.
However, the regulation was later deemed to grant the right to a lower court fee to an excessively wide range of entities.
The amendment was passed by the Senate and presented to the President on 12 February 2016.
Pursuant to the amended Article 13 Paragraph 1a of the act a reduced relative fee remains effective only in the case of claims resulting from banking activities asserted by a consumer or a natural person who conducts a family agricultural business.
